What does a conveyancer do?
Conveyancing is the legal process of creating and extinguishing interests in land and personal property, and involves various stages, including the preparation, review, and execution of legal documents, as well as the coordination of settlement.
A conveyancer is a licensed professional who specializes in managing this process on behalf of the buyer or seller, ensuring that all legal requirements are met and that the transaction is completed smoothly.
Conveyancers vs. Solicitors: Both conveyancers and solicitors can provide conveyancing services. However, conveyancers like me specialise in their targeted area of property law, while solicitors may cover various legal areas as specialists or generalists.
Here are some key aspects of conveyancing and the role of a conveyancer:
Legal Representation: A conveyancer will act as your legal representative in the property transaction, ensuring that all legal requirements are met and that the process is completed smoothly.
Property due diligence: A conveyancer conducts thorough research on the property, including title searches to identify the legal owner, checking for easements or encumbrances, and verifying zoning and land use regulations.
Preparation and review of legal documents: Conveyancers prepare and review essential legal documents, such as the Contract of Sale. They ensure that these documents are accurate, compliant with the relevant laws, and protect the interests of their client.
Contract negotiation: A conveyancer can help clients negotiate the terms and conditions of the Contract of Sale, providing guidance on potential amendments and ensuring that the contract is fair and balanced.
Liaising with stakeholders: Conveyancers communicate with various parties involved in the transaction, such as real estate agents, mortgage brokers, banks, and solicitors. They help coordinate the process and ensure satisfactory outcomes via the settlement process.
